OZPATH PTY LTD DOES NOT PROVIDE IMMIGRATION ADVICE OF ANY KIND. MIGRATION ADVICE IS EXCLUSIVELY PROVIDED BY REGISTERED MIGRATION AGENTS WHO ARE INDEPENDENT FROM OZPATH PTY LTD. ALL INFORMATION PROVIDED THROUGH THIS APPLICATION IS FOR GENERAL GUIDANCE AND EDUCATIONAL PURPOSES ONLY. IF YOU REQUIRE IMMIGRATION ADVICE, YOU MUST ENGAGE A REGISTERED MIGRATION AGENT OR QUALIFIED IMMIGRATION LAWYER.
1. ACCEPTANCE OF TERMS
1.1 About OzPath
Welcome to OzPath ("Application" or "App"). OzPath is a technology, information, planning, and case-management platform designed to assist international students, temporary visa holders, and prospective visa applicants in Australia and overseas. OzPath is not a migration agent or law firm and does not provide migration advice or legal advice.
OzPath provides the following features and services:
- (a) Free features: user account creation and management; PR profile creation and management; PR points calculator; target occupation selection; occupation demand and invitation activity browsing; core EOI dashboard information, including invitation and active-EOI data; exploration of study, points-tested, regional, and employer-sponsored pathways; CRICOS course and training pathway browsing linked to occupations; migration education content and blog articles; Ruby AI, the in-app AI migration guide; NAATI-certified document translation services, including document upload, payment, and translation-case tracking; and booking and paying for one-to-one video consultations with registered migration agents.
- (b) OzPath Pro (paid subscription): all Free features, plus full EOI analytics as described in Section 1.6.
- (c) Case management: available only to users with an active matter involving a registered migration agent, including users who decide to proceed with an agent following a video consultation and users who join through a registered migration agent's referral code. Case management is not a standard Free feature and is not included in an OzPath Pro subscription.
Registered migration agents accessible through OzPath are independent professionals. They are solely responsible for their own migration advice, professional services, service agreements, and migration work. OzPath facilitates planning tools, information, payments, video consultations, document exchange, communications, and case-management workflows only.
1.2 Agreement to Terms
By creating an account, accessing, or using OzPath, you acknowledge that you have read, understood, and agree to be bound by these General Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Application.
1.3 Service Tiers
OzPath offers both free and paid subscription tiers. These Terms apply to all users regardless of subscription tier.
1.4 Eligibility
You may not use the Application if:
- (a) you are not of legal age to form a binding contract under Australian law; or
- (b) you are prohibited from receiving the services under the laws of Australia or your country of residence.
By creating an account, you confirm that you meet the eligibility requirements above. During onboarding, you will be asked to indicate whether you are currently in Australia on an Australian visa or applying from overseas, and to provide relevant information about your current visa status, migration goals, qualifications, and preferences as prompted. You must ensure all information you provide is accurate and complete.
1.5 International Users
OzPath is operated by OZPATH PTY LTD, an Australian company based in New South Wales, Australia.
OzPath provides Australian migration education, planning tools, software features, and a technology platform that helps users connect with Australian Registered Migration Agents. OzPath does not provide immigration advice, legal advice, recruitment services, employment placement services, education agency services, or local migration services in any country.
If you access or use OzPath from outside Australia, you acknowledge and agree that:
- (a) OzPath is designed for Australian migration-related information, tools, and services;
- (b) any professional migration advice or migration services are provided only by independent Registered Migration Agents, not by OzPath;
- (c) OzPath does not advise you on the laws, visa systems, emigration requirements, employment rules, recruitment rules, or professional licensing requirements of your country of residence;
- (d) you are responsible for ensuring that your access to and use of OzPath is lawful in your country of residence or any country from which you access the Application;
- (e) you must not use OzPath if doing so would breach any law, regulation, court order, sanctions restriction, professional rule, or other legal requirement that applies to you;
- (f) OzPath may restrict, suspend, or disable access to the Application or specific features in any country or region where OZPATH PTY LTD determines that legal, regulatory, payment, privacy, security, operational, or commercial risks are unacceptable; and
- (g) these Terms are governed by the laws of New South Wales, Australia, subject to any mandatory consumer protection laws or privacy rights that cannot lawfully be excluded in your country of residence.
Nothing in these Terms requires OZPATH PTY LTD to make the Application available in any particular country or region.
1.6 OzPath Pro Subscription Service
1.6.1 Service Description
OzPath Pro is an optional premium subscription service that provides users with enhanced EOI analytics features to support their Australian permanent residency pathway planning. OzPath Pro includes all Free features plus the additional features described in clause 1.6.2.
1.6.2 Features Included
OzPath Pro subscribers receive access to all Free features, plus:
- (a) Full EOI Analytics: complete EOI and invitation data access across all visa subclasses and occupation streams, including typical points ranges for invited applicants and active EOIs, the number of active EOIs with higher points than the user, and points-distribution views for invitations and active EOIs (detailed terms in Section 7).
1.6.3 Subscription Model
- (a) OzPath Pro operates as a monthly recurring subscription with automatic renewal.
- (b) Accessible on iOS and Android platforms.
- (c) Cancellation is available at any time through your device's subscription management settings.
- (d) Upon cancellation, access to Pro features continues until the end of the current billing period.
- (e) Pricing and subscription terms are managed through in-app purchase platforms (Apple App Store, Google Play Store) and are subject to their respective terms and conditions.
- (f) Subscription fees are charged in advance on a monthly basis.
1.6.4 What OzPath Pro Does NOT Include
OzPath Pro subscribers acknowledge and agree that the subscription does not include:
- (a) Agent Chat or any direct access to a registered migration agent.
- (b) Case management tools (which are available only to users with an active agent matter — see Section 6A).
- (c) Professional visa application lodgement or formal legal representation.
- (d) Guarantee of visa approval or invitation outcomes.
- (e) Direct assistance with visa application forms or document submission.
- (f) Formal client-agent representation agreements (which must be negotiated separately with individual agents).
- (g) Real-time or guaranteed response times from migration agents.
- (h) Video consultations (which are available as a separate paid service to all signed-in users regardless of subscription tier — see Section 6).
- (i) NAATI-certified document translation services (which are available as a separate paid service to all signed-in users).
- (j) Access to features or data beyond those explicitly described in these Terms.
1.6.5 Access Requirements
To access OzPath Pro features, you must maintain:
- (a) An active subscription to OzPath Pro with current payment.
- (b) A valid user account with a verified email address.
- (c) Compliance with these Terms of Service and all applicable policies.
- (d) A compatible device running a supported version of iOS or Android.
1.6.6 Service Purpose and Limitations
OzPath Pro is designed to complement, not replace, formal immigration advice from qualified migration agents or lawyers. All information, data, and preliminary guidance provided through OzPath Pro features are for informational and educational purposes only.
Users remain solely responsible for:
- (a) Verifying all information with official Department of Home Affairs sources
- (b) Obtaining professional advice specific to their individual circumstances
- (c) Making informed decisions about their visa applications and immigration matters
- (d) Complying with all Australian immigration laws and regulations
1.6.7 Subscription Modifications and Termination
OZPATH PTY LTD reserves the right to:
- (a) Modify OzPath Pro features, pricing, or subscription terms at any time with reasonable notice to existing subscribers
- (b) Suspend or terminate OzPath Pro subscriptions for breach of these Terms
- (c) Discontinue OzPath Pro service with reasonable notice to subscribers
- (d) Add, remove, or modify specific features within the OzPath Pro subscription tier
Price changes for existing subscribers will be communicated at least 30 days in advance and will take effect at the next billing cycle.
2. GOVERNMENT NON-AFFILIATION
OZPATH PTY LTD is not affiliated with, endorsed by, or connected to the Department of Home Affairs or any Australian government department or agency. OzPath is an independent service providing information and tools only. All official immigration matters must be conducted through appropriate government channels or with registered migration agents.
The PR calculators, EOI dashboards, visa information content, and other features provided by OzPath are informational tools only and do not represent official government data, endorsements, or guarantees.
3. ACCOUNT REGISTRATION
3.1 Creating an Account
To access OzPath services, you must register for an account. During registration, you may be required to provide:
- (a) Email address
- (b) Password
- (c) Country of origin
- (d) Currrent visa information
- (e) PR profile information (if using PR calculator features)
- (f) Other information as requested
3.2 Account Information Accuracy
You warrant that all information provided during registration and throughout your use of the Application is accurate, current, and complete. You agree to update your information promptly if it changes.
You acknowledge that the accuracy of any calculations, estimates, or outputs provided by OzPath (including PR points calculations and EOI insights) depends entirely on the accuracy and completeness of the information you provide.
3.3 Account Security
You are solely responsible for:
- (a) Maintaining the confidentiality of your password and account credentials
- (b) All activities that occur under your account
- (c) Immediately notifying OZPATH PTY LTD of any unauthorised use or security breach
Any use of your account by another person is strictly prohibited. Unauthorised use may result in immediate termination of your account.
4. DATA COLLECTION, STORAGE, AND SHARING
4.1 Information We Collect and Store
OzPath collects and stores the following data:
- (a) User authentication information (email and account details)
- (b) Preliminary questionnaire responses
- (c) PR profile data including: age bracket, English level, Australian work experience, overseas work experience, education qualifications, Australian study details, professional year completion, NAATI CCL status, partner points factors, regional study indicators, sponsorship/state nomination indicators, and derived data such as points breakdown and total points
- (d) Chat history with migration agents, including messages, attachments, and metadata
- (e) Files and documents exchanged between you and migration agents through the platform, retained for the duration of the service engagement or as otherwise required by law
- (f) Checklist and to-do list data, including assigned tasks, completion status, and associated agent instructions
- (g) Service quote data, including quote details, acceptance status, and associated correspondence
- (h) Notification preferences and scheduled reminders
- (i) Checklist completion status and progress tracking
- (j) Document classification and translation requirements (temporarily, during processing)
- (k) Subscription and payment information (plan/tier, purchase date, expiry date, payment identifiers)
- (l) Usage analytics and feature interaction data
- (m) EOI Dashboard interaction data including viewed occupations, saved searches, and competitiveness score calculations
4.2 Information We Do NOT Store
OzPath does not store:
- (a) Full payment card details (processed securely by third-party payment providers)
- (b) Permanent copies of uploaded documents beyond processing requirements
- (c) Biometric data
- (d) Government identification documents (beyond temporary processing)
4.3 Third-Party Processing
Your data may be processed by:
- (a) Firebase for authentication services and data storage
- (b) Stripe and Apple Pay for payment processing
- (c) Analytics providers for service improvement and diagnostics
- (d) Translation service providers for document translation (temporary access only)
- (e) Contracted migration agents who may access your chat history, questionnaire responses, PR profile data, files and documents, checklist data, and service quote data as necessary to provide services
4.4 Sharing with Migration Agents
For all users who access Agent Chat:
By purchasing such services, you explicitly consent to OZPATH PTY LTD sharing your:
- (a) Account information and contact details
- (b) Visa-related questionnaire responses
- (c) Chat history and interaction logs
- (d) Progress tracking and checklist data
- (e) Files and documents exchanged through the platform
- (f) Service quote data and associated correspondence
Migration agents are bound by confidentiality obligations and professional standards under Australian law and the Migration Agents Registration Authority (MARA) Code of Conduct.
4.5 Data Retention and Deletion
- (a) Chat histories are retained according to service operational limits
- (b) Limited offline functionality and data access may be available
- (c) You may request deletion of your data by deleting your account (see Section 11)
- (d) Upon account deletion, your personal data will be deleted within a reasonable timeframe, subject to legal retention requirements
4.6 Privacy Policy
For full details on how we collect, use, and protect your information, please review our Privacy Policy available at www.ozpath.au/appprivacy.
OZPATH PTY LTD may update the Privacy Policy from time to time. Material changes will be communicated to you, and continued use of the Application constitutes acceptance.
5. YOUR OBLIGATIONS AS A USER
As a user of OzPath, you agree to:
5.1 Permitted Use
- (a) Use the Application only for lawful purposes and in accordance with these Terms
- (b) Comply with all applicable laws, regulations, and professional standards
- (c) Use the Application solely for personal, non-commercial purposes (unless expressly authorised)
5.2 Account Responsibility
- (a) Protect the confidentiality of your password and account credentials
- (b) Notify OZPATH PTY LTD immediately of any unauthorised access or security breach
- (c) Accept sole responsibility for all activity conducted through your account
5.3 Prohibited Conduct
You agree not to:
- (a) Use the Application for any illegal, unauthorised, or fraudulent purpose
- (b) Collect information about other users (including email addresses) for unsolicited communication
- (c) Engage in any commercial activity through the Application without express authorisation
- (d) Use automated systems (bots, scrapers, etc.) to access or interact with the Application
- (e) Attempt to gain unauthorised access to any part of the Application, other user accounts, or connected systems
- (f) Upload or transmit viruses, malware, or other harmful code
- (g) Interfere with or disrupt the Application's operation or servers
- (h) Misrepresent your identity or affiliation with any person or entity
- (i) Post or transmit any content that is unlawful, defamatory, harassing, abusive, or otherwise objectionable
5.4 Commercial Solicitation
Unsolicited commercial advertisements, affiliate links, and other forms of solicitation may be removed without notice and may result in termination of your account. OZPATH PTY LTD reserves the right to take legal action for any illegal or unauthorised use of the Application.
6. VIDEO CONSULTATIONS
6.1 Service Description
OzPath enables signed-in users to book and pay for one-to-one video consultations with registered migration agents. Video consultations are a paid service available to all signed-in users, regardless of subscription tier. Neither Free access nor an OzPath Pro subscription includes a video consultation or direct access to a registered migration agent.
6.2 Booking Process
- (a) You select an available registered migration agent and pay the applicable consultation fee through OzPath.
- (b) Where appointment slots are available, you may select a preferred time. Otherwise, the agent will confirm the appointment time after booking.
- (c) The agent sends the video-call link through OzPath. You can view consultation details and join the call from within the Application.
- (d) Consultation fees are charged at the time of booking and are subject to the pricing displayed in the Application at the time of purchase.
6.3 Nature of Video Consultations
You acknowledge and agree that:
- (a) A video consultation is a professional service provided by the registered migration agent, not by OzPath.
- (b) OzPath facilitates the booking, payment, and communication workflow only. OzPath is not the migration adviser and is not responsible for the content, quality, or outcome of any consultation.
- (c) The registered migration agent remains solely responsible for their professional advice, conduct, and services delivered during and following the consultation.
- (d) A video consultation does not automatically create a formal client-agent engagement. A formal engagement requires a separate service agreement between you and the agent.
- (e) Agents cannot and do not guarantee visa outcomes, processing times, or application success.
6.4 Agent Registration and Independence
All registered migration agents accessible through OzPath:
- (a) Are registered with the Migration Agents Registration Authority (MARA) and hold current registration.
- (b) Display their MARN (Migration Agent Registration Number), which can be verified at mara.gov.au.
- (c) Operate as independent contractors and are not employees or agents of OZPATH PTY LTD.
- (d) Are bound by the MARA Code of Conduct and applicable professional standards.
6.5 Recording
- (a) Video calls may be recorded where required for professional record-keeping purposes. You will be notified prior to any recording taking place and your consent will be sought.
- (b) You must not record any video call without the express prior consent of the agent and OZPATH PTY LTD.
- (c) Video call recordings are stored securely and are accessible only to you and the assigned agent, subject to any applicable legal obligations.
6.6 Availability and Technical Limitations
- (a) Agent availability varies and appointment times are not guaranteed until confirmed.
- (b) OZPATH PTY LTD does not guarantee the technical quality, availability, or continuity of video call functionality and is not liable for any disruption, disconnection, or technical failure during a video call.
6.7 Privacy and Confidentiality
- (a) Consultation records are stored securely and accessible only to you and the assigned agent.
- (b) Agents must maintain client confidentiality in accordance with MARA requirements.
- (c) OZPATH PTY LTD does not share consultation content with third parties except as required by law or with your consent.
6.8 Platform Liability Limitations
OZPATH PTY LTD expressly disclaims liability for:
- (a) Any advice, guidance, recommendations, or services provided by agents during or following a video consultation.
- (b) The professional conduct, competence, or performance of individual agents.
- (c) Any visa application outcomes or immigration decisions resulting from agent communications or services.
- (d) Any technical failure, interruption, or unavailability of video call functionality.
- (e) Any loss, damage, or adverse consequences arising from your reliance on agent communications or consultation content.
6A. CASE MANAGEMENT AND ACTIVE AGENT MATTERS
6A.1 When Case Management Becomes Available
Case management tools become available when a user has an active matter involving a registered migration agent. This occurs in the following circumstances:
- (a) you decide to proceed with a registered migration agent following a video consultation booked through OzPath; or
- (b) you join OzPath through a referral code issued directly by a registered migration agent.
Case management is not a standard Free feature and is not included in an OzPath Pro subscription. It is available only in connection with an active agent matter as described above.
6A.2 Case Management Features
Where case management is available, it may include:
- (a) Secure messaging with the agent.
- (b) Secure document exchange and file sharing.
- (c) Assigned tasks, information requests, forms, and checklists accessible through My Tasks.
- (d) Document uploads in response to agent requests.
- (e) Review and electronic signing of service agreements issued by the agent.
- (f) Review, acceptance or declination, and payment of service quotes where available.
- (g) Review and payment of invoices, and downloading of invoices and receipts.
- (h) Video-call details and the ability to join video calls from within the Application.
6A.3 Referral Code Users
A registered migration agent may issue a referral code directly to a prospective user. Where you enter a referral code during onboarding or account creation:
- (a) The referral code links your account to the referring registered migration agent.
- (b) You will have access to your agent case workspace without requiring an OzPath Pro subscription.
- (c) The referring agent may assign tasks, document requests, forms, and checklists to you through the platform.
- (d) You may upload requested documents, track progress, and communicate with the agent through OzPath.
- (e) You may receive, review, and electronically sign service agreements issued by the agent.
- (f) You may receive service quotes, accept or decline them, and make payment through OzPath where available.
- (g) You may receive invoices, make payment, and download receipts.
- (h) You may receive video-consultation details and join video calls through OzPath.
6A.4 Nature of Case Management — OzPath's Role
You acknowledge and agree that:
- (a) OzPath facilitates the operational workflow of case management only. OzPath is not the migration adviser and is not a party to any service agreement between you and the agent.
- (b) The registered migration agent remains solely responsible for their advice, professional services, service agreements, and migration work.
- (c) Referral-code access does not make OzPath the migration adviser. The referring registered migration agent remains responsible for their own advice and professional services.
- (d) OZPATH PTY LTD is not a party to any service agreement, quote, or engagement formed between you and a registered migration agent through the platform.
6A.5 Service Agreements and Electronic Signatures
- (a) Agents may issue service agreements to you through the platform outlining the scope, fees, and terms of proposed migration services.
- (b) You may review and electronically sign service agreements through the Application. Your electronic signature constitutes a binding acceptance of the terms of that agreement between you and the agent.
- (c) OZPATH PTY LTD does not review, verify, or take responsibility for the content, accuracy, fairness, or enforceability of any service agreement issued by an agent.
- (d) You should read any service agreement carefully before signing. If you require independent legal advice before signing, you should obtain it before proceeding.
6A.6 Service Quotes
- (a) Agents may issue service quotes to you through the platform outlining the scope, fees, and terms of proposed migration services.
- (b) A quote does not constitute a binding agreement until expressly accepted by you within the platform.
- (c) Upon acceptance of a quote, a direct service agreement is formed between you and the agent. OZPATH PTY LTD is not a party to that agreement and accepts no liability in connection with it.
- (d) Any fees payable under a service quote are payable directly to the agent in accordance with the terms of the quote, unless otherwise specified on the platform.
- (e) OZPATH PTY LTD does not guarantee the accuracy, completeness, or fairness of any quote issued by an agent.
- (f) Disputes regarding service quotes must be resolved directly between you and the agent, or through MARA's complaint process.
6A.7 Invoices and Payments
- (a) Agents may issue invoices to you through the platform for migration services rendered.
- (b) You may review, pay, and download invoices and receipts through the Application where payment functionality is available.
- (c) OZPATH PTY LTD facilitates payment processing only and is not responsible for the underlying services to which any invoice relates.
- (d) Disputes regarding invoices must be resolved directly between you and the agent.
6A.8 Tasks, Checklists, and Document Uploads
- (a) Agents may assign tasks, information requests, forms, and checklists to you through My Tasks to assist in managing migration service requirements.
- (b) You are responsible for completing tasks accurately and within any timeframes specified by your agent, as delays may affect your application or service timeline.
- (c) Tasks and checklists are provided as a service management tool only and do not constitute legal advice or a guarantee that completion of all items will result in a successful visa outcome.
- (d) OZPATH PTY LTD is not responsible for any loss or adverse outcome arising from incomplete, inaccurate, or delayed completion of tasks or checklist items.
6A.9 File and Document Exchange
- (a) You must only upload files and documents that are accurate, genuine, and that you are lawfully authorised to share. Uploading fraudulent, forged, or misleading documents may constitute a criminal offence under Australian law.
- (b) Files and documents exchanged through the platform are stored securely and accessible only to you and the assigned agent, subject to applicable legal obligations.
- (c) OZPATH PTY LTD does not review, verify, or take responsibility for the content, accuracy, or authenticity of any files or documents exchanged between you and an agent through the platform.
- (d) You grant OZPATH PTY LTD and the assigned agent a limited, non-exclusive licence to access, store, and process files uploaded through the platform solely for the purpose of delivering the requested services. This licence terminates upon completion of the relevant service or deletion of your account.
- (e) OZPATH PTY LTD is not liable for any loss, damage, or adverse consequence arising from the exchange, use, or reliance on files or documents shared through the platform.
6A.10 Privacy and Confidentiality
- (a) Case communications, files, and associated data are stored securely and accessible only to you and the assigned agent.
- (b) Agents must maintain client confidentiality in accordance with MARA requirements.
- (c) OZPATH PTY LTD does not share case content with third parties except as required by law or with your consent.
6A.11 Professional Conduct and Complaints
- (a) All agents must adhere to the MARA Code of Conduct.
- (b) You may report unprofessional conduct directly to MARA.
- (c) OZPATH PTY LTD reserves the right to remove agents who violate platform policies.
- (d) Disputes between you and agents, including those arising from service agreements, service quotes, invoices, tasks, or file exchanges, must be resolved directly between the parties or through MARA's complaint process.
6A.12 Platform Liability Limitations
OZPATH PTY LTD expressly disclaims liability for:
- (a) Any advice, guidance, recommendations, or services provided by agents through the platform, including through messaging, video calls, service agreements, service quotes, tasks, checklists, or file exchanges.
- (b) The professional conduct, competence, or performance of individual agents.
- (c) Any visa application outcomes or immigration decisions resulting from agent communications or services delivered through the platform.
- (d) Disputes, disagreements, or contractual arrangements between you and agents, including those arising from accepted service quotes or signed service agreements.
- (e) Any loss, damage, or adverse consequences arising from your reliance on agent communications, service quotes, service agreements, tasks, checklists, or exchanged files and documents.
- (f) Any technical failure, interruption, or unavailability of case management features, file exchange, or any other platform functionality.
7. EOI DASHBOARD FEATURE
7.1 Service Description
The EOI Dashboard provides historical data and statistical analysis regarding Expression of Interest (EOI) invitations for various visa subclasses and occupations. This feature displays information sourced from publicly available Department of Home Affairs records.
7.2 Data Sources and Accuracy
You acknowledge and agree that:
- (a) EOI data is sourced from publicly available Department of Home Affairs records and third-party data providers
- (b) Data may not reflect real-time changes, current policies, or the most recent invitation rounds
- (c) All data is provided "as-is" without warranty of accuracy, completeness, currency, or reliability
- (d) OZPATH PTY LTD does not guarantee the accuracy or completeness of any displayed data
- (e) Data refresh frequency is not guaranteed and may vary by source
7.3 Competitiveness Scores and Statistical Analysis
Competitiveness scores and statistical analyses displayed in the EOI Dashboard:
- (a) Are estimates based on historical data and statistical modelling only
- (b) Do not predict or guarantee future invitation outcomes
- (c) Should not be solely relied upon for making visa application decisions
- (d) May not account for policy changes, occupation list updates, or shifting Department priorities
- (e) Are provided for informational and educational purposes only
7.4 Limitations and Exclusions
The EOI Dashboard does not and cannot:
- (a) Guarantee that displayed data reflects current Department of Home Affairs policies or priorities
- (b) Account for all factors that influence invitation decisions (including unpublished criteria)
- (c) Reflect state nomination pathways' additional criteria or requirements

7.5 User Responsibilities
When using the EOI Dashboard, you must:
- (a) Verify all information with official Department of Home Affairs sources before making visa decisions
- (b) Regularly check for policy updates, occupation list changes, and invitation round announcements
- (c) Consult with a registered migration agent for advice specific to your circumstances
- (d) Acknowledge that historical trends do not guarantee future outcomes
- (e) Not rely solely on dashboard data for critical immigration decisions
7.6 Service Modifications
OZPATH PTY LTD reserves the right to:
- (a) Modify, suspend, or discontinue data feeds without notice
- (b) Change data sources, calculation methodologies, or display formats
- (c) Limit access to certain data sets or features based on subscription tier
- (d) Update or correct historical data when errors are identified
7.7 No Liability for Visa Outcomes
OZPATH PTY LTD is not responsible for:
- (a) Visa application outcomes based on data viewed in the EOI Dashboard
- (b) Decisions made in reliance on competitiveness scores or historical trends
- (c) Changes to visa policies, occupation lists, or invitation criteria that affect your application
- (d) Any loss, damage, or adverse consequences arising from your use of dashboard data
8. RUBY AI ASSISTANT
8.1 Service Description
Ruby AI is OzPath's in-app AI migration guide, available to Free and OzPath Pro users subject to fair-use limits. Ruby AI is designed to provide users with general information about visa pathways, occupations, PR points, course options, EOI data, and general next steps. Ruby AI may direct users to relevant OzPath tools, including occupation search, course search, and the EOI dashboard.
8.2 Nature and Limitations of Ruby AI
You acknowledge and agree that:
- (a) Ruby AI does not provide personal migration advice, legal advice, or professional advice of any kind, whether formal or informal.
- (b) Ruby AI is not a registered migration agent and is not authorised to provide migration advice under the Migration Act 1958 (Cth).
- (c) Any responses provided by Ruby AI are for general informational and educational purposes only and must not be relied upon as immigration, legal, or professional advice.
- (d) Interactions with Ruby AI do not establish any professional, advisory, or client relationship between you and OZPATH PTY LTD.
- (e) Ruby AI's responses are generated by an AI system and may contain inaccuracies, errors, or omissions. You must independently verify all information with official Department of Home Affairs sources before making any visa or immigration decision.
8.3 Ruby AI Chat History and Document Uploads
- (a) Ruby AI chat history and conversation context are saved for signed-in users to enable continuity across sessions.
- (b) You may voluntarily upload documents for Ruby AI to review. You acknowledge that documents you upload may contain sensitive personal or immigration-related information and that by uploading such documents you consent to their processing by Ruby AI and the underlying AI service provider for the purpose of generating a response.
- (c) You must only upload documents that you are lawfully authorised to share and that do not contain fraudulent, forged, or misleading information.
- (d) OZPATH PTY LTD does not review documents uploaded to Ruby AI and is not responsible for any response generated by Ruby AI in connection with uploaded documents.
8.4 Fair-Use Limits
Ruby AI is available subject to fair-use limits as determined by OZPATH PTY LTD from time to time. OZPATH PTY LTD reserves the right to limit, suspend, or modify Ruby AI access where usage exceeds reasonable limits or where misuse is detected.
8.5 If You Require Migration Advice
Ruby AI cannot provide migration advice. If you require professional migration advice, you must:
- (a) book a paid video consultation with a registered migration agent through OzPath (see Section 6); or
- (b) engage a registered migration agent or qualified immigration lawyer independently outside of the OzPath platform.
8.6 Disclaimer
OZPATH PTY LTD expressly disclaims all liability for:
- (a) any reliance placed on responses generated by Ruby AI;
- (b) any loss, damage, or adverse consequences arising from your use of or reliance on Ruby AI responses;
- (c) any inaccuracies, errors, or omissions in Ruby AI's responses;
- (d) any visa application outcomes or immigration decisions made in reliance on Ruby AI responses; and
- (e) any consequences arising from documents you voluntarily upload to Ruby AI, including any response generated by Ruby AI in connection with those documents.
9. PAYMENT AND SUBSCRIPTIONS
9.1 Payment Processing
Payments through OzPath are processed securely by third-party payment providers, including Stripe and Apple Pay for consultations, quotes, invoices, and translation services, and the Apple App Store and Google Play Store for OzPath Pro subscription payments. By making a payment, you agree to be bound by the applicable terms and conditions of the relevant payment provider.
OzPath does not store full payment-card details. Payment-card processing is handled directly by the applicable payment provider.
9.2 Types of Charges
You may incur the following types of charges through OzPath:
- (a) OzPath Pro subscription fees: recurring monthly fees charged in advance through the Apple App Store or Google Play Store.
- (b) Video consultation fees: one-off fees charged at the time of booking a consultation with a registered migration agent.
- (c) Translation service fees: fees charged at the time of ordering a NAATI-certified document translation.
- (d) Agent service quote payments: payments made in connection with a service quote accepted through the platform, payable to the agent in accordance with the terms of the quote.
- (e) Agent invoice payments: payments made in connection with invoices issued by a registered migration agent through the platform.
Each type of charge may be subject to separate terms. You should review all applicable terms before making any payment.
9.3 Payment Responsibility
You are responsible for:
- (a) ensuring your payment method is valid and has sufficient funds;
- (b) any costs, fees, or charges (including banking fees) associated with failed, returned, or denied payments; and
- (c) reviewing all pricing and terms before confirming any payment.
9.4 Subscription Pricing
OZPATH PTY LTD reserves the right to vary OzPath Pro subscription pricing at any time. Existing subscribers will be notified of price changes at least 30 days in advance, and changes will take effect at the next billing cycle. Consultation fees, translation fees, and agent service fees are set and displayed at the time of booking or purchase and may vary.
9.5 Cancellation of OzPath Pro
- (a) You may cancel your OzPath Pro subscription at any time through your device's subscription management settings (Apple App Store or Google Play Store).
- (b) Upon cancellation, access to OzPath Pro features continues until the end of the current billing period.
- (c) Cancellation of OzPath Pro does not affect any active agent matter, case management access, or obligations arising from any service agreement or quote accepted with a registered migration agent.
9.6 Refunds
- (a) OZPATH PTY LTD does not offer refunds for OzPath Pro subscription purchases, video consultation fees, or translation service fees, except where required by law.
- (b) Nothing in this refund policy limits or excludes your rights under the Australian Consumer Law. If our services fail to meet a consumer guarantee under the Australian Consumer Law, you may be entitled to a remedy including a refund, replacement, or compensation as applicable.
- (c) Refunds in connection with agent service quotes or invoices are a matter between you and the relevant registered migration agent and are not the responsibility of OZPATH PTY LTD.
9.7 Subscription Administration
OzPath Pro subscriptions are administered through RevenueCat and the Apple App Store or Google Play Store. Subscription entitlements, renewal dates, and cancellation are managed through those platforms and are subject to their respective terms and conditions.
10. INTELLECTUAL PROPERTY
10.1 OzPath Ownership
The Application, its content, design, features, and all related intellectual property (including but not limited to text, graphics, logos, software, code, and trademarks) are owned by or licensed to OZPATH PTY LTD and protected by Australian and international copyright and intellectual property laws.
10.2 Limited License to Users
OZPATH PTY LTD grants you a limited, non-exclusive, non-transferable, revocable license to:
- (a) Access and use the Application for personal, non-commercial purposes
- (b) Cache the Application in your device's memory as necessary for operation
- (c) Print or save content from the Application for personal reference only
10.3 Restrictions
You may not, without prior written permission:
- (a) Reproduce, modify, distribute, or publicly display any part of the Application
- (b) Reverse engineer, decompile, or disassemble any software or code
- (c) Remove or alter any copyright, trademark, or proprietary notices
- (d) Use the Application or its content for any commercial purpose
- (e) Create derivative works based on the Application
10.4 User-Uploaded Documents
You retain ownership of any documents you upload to OzPath. However, by uploading documents, you grant OZPATH PTY LTD and its authorised service providers (including migration agents and translators) a limited, non-exclusive license to:
- (a) Access, store, and process your documents as necessary to provide services
- (b) Transmit documents to contracted migration agents (for paid subscribers) and translators
- (c) Use documents for quality assurance and service improvement (in de-identified form)
- (d) This license terminates upon completion of the relevant service or deletion of your account.
11. DISCLAIMERS AND LIMITATION OF LIABILITY
11.1 Australian Consumer Law
Nothing in these Terms limits or excludes any rights, guarantees, or remedies you may have under the Australian Consumer Law or other mandatory consumer protection laws that cannot be lawfully excluded.
11.2 General Disclaimers
Subject to the above, and to the maximum extent permitted by law:
- (a) The Application and all services are provided "as is" and "as available" without any warranties of any kind, whether express or implied
- (b) OZPATH PTY LTD does not warrant that the Application will be uninterrupted, error-free, secure, or free from viruses or harmful components
- (c) OZPATH PTY LTD does not guarantee any specific outcome from using the Application, including visa application success
11.3 No Immigration Advice Guarantee
(a) OZPATH PTY LTD expressly disclaims all liability for:
- (i) Any decisions you make based on information obtained through the Application (including from the EOI Dashboard, migration agents, or any other feature)
- (ii) Inaccuracies, errors, omissions, or outdated information in EOI data or other content provided
- (iii) Any loss, damage, or adverse consequences arising from your reliance on Application content, EOI data, competitiveness scores, or agent communications
- (iv) The outcomes of any visa application, EOI submission, or immigration matter
- (v) Changes to visa policies, occupation lists, invitation criteria, or Department of Home Affairs priorities that affect your circumstances
(b) You acknowledge and agree that:
- (i) OzPath is an informational and facilitation tool only
- (ii) Use of OzPath does not guarantee any visa outcome
- (iii) You are solely responsible for your immigration decisions
- (iv) Historical EOI data and trends do not predict or guarantee future invitation outcomes
11.4 Third-Party Services and Agent Conduct
OZPATH PTY LTD is not responsible for:
- (a) The operation, reliability, or availability of third-party services (including Stripe, Firebase, AI providers, translation services, or data providers)
- (b) Any acts or omissions of third-party service providers
- (c) The performance, conduct, advice, or professional competence of migration agents accessed through Agent Chat
- (d) The accuracy, completeness, or timeliness of data provided by third-party data sources for the EOI Dashboard
11.5 Limitation of Liability
To the maximum extent permitted by law, OZPATH PTY LTD's total liability for any claims arising from or related to your use of OzPath (including use of the EOI Dashboard, Agent Chat, or any other feature), whether in contract, tort (including negligence), statute, or otherwise, shall not exceed:
- (a) For free users: $100 AUD
- (b) For paid subscribers: the amount you paid for services in the 12 months preceding the claim
11.6 Exclusion of Consequential Damages
To the maximum extent permitted by law, OZPATH PTY LTD shall not be liable for any:
- (a) Indirect, incidental, special, consequential, or exemplary damages
- (b) Loss of profits, revenue, business opportunities, goodwill, or data
- (c) Costs of substitute services or products
- (d) Visa refusal, cancellation, delay, or adverse immigration outcomes
- (e) Missed EOI invitation opportunities or decisions based on EOI Dashboard data
- (f) Losses arising from agent advice, conduct, or unavailability through Agent Chat
This exclusion applies regardless of whether OZPATH PTY LTD was advised of the possibility of such damages.
11.7 Your Responsibility
You acknowledge that:
- (a) You use OzPath entirely at your own risk
- (b) You are responsible for evaluating the accuracy and reliability of all information, including EOI data and agent communications
- (c) You should take all necessary precautions, including backing up important data and documents
- (d) You must comply with all applicable immigration laws and requirements
- (e) You must independently verify all information with official Department of Home Affairs sources before making critical decisions
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless OZPATH PTY LTD, its affiliates, officers, directors, employees, agents, contractors, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable legal fees), arising from or related to:
- (a) Your use or misuse of the Application (including the EOI Dashboard and Agent Chat)
- (b) Your breach of these Terms or any applicable Service Terms
- (c) Your violation of any law or the rights of any third party
- (d) Any content you submit, upload, or transmit through the Application
- (e) Any decisions or actions you take based on information obtained through OzPath, including EOI data, competitiveness scores, or agent communications
- (f) Your reliance on EOI Dashboard data for visa application decisions
- (g) Any disputes or claims arising from your interactions with migration agents through Agent Chat
13. ACCEPTABLE USE POLICY
13.1 Prohibited Uses
In addition to the prohibitions set out in Section 5.3, you specifically agree not to:
- (a) Use the EOI Dashboard or any Application features for fraudulent purposes or to misrepresent your visa eligibility
- (b) Attempt to circumvent subscription requirements or access restrictions for paid features
- (c) Scrape, harvest, or systematically collect EOI data or other Application content
- (d) Resell, redistribute, or commercially exploit Application data or services
- (e) Harass, abuse, or send unsolicited communications to migration agents through Agent Chat
- (f) Violate any Australian immigration laws or regulations
- (g) Record any video call conducted through the platform without the express prior consent of the agent
- (h) Upload, transmit, or share fraudulent, forged, unlawful, or misleading information or documents through any part of the Application, including Ruby AI, case management, or document exchange features.
- (i) Use Ruby AI to seek or obtain personal migration advice, legal advice, or professional advice of any kind.
- (j) Enter a referral code issued by a registered migration agent for any purpose other than your own genuine migration matter.
- (k) Accept a service quote or sign a service agreement issued by an agent on behalf of another person or for any purpose other than your own genuine migration matter.
- (l) Attempt to access case management features without an active agent matter or a valid referral code.
14. ACCOUNT TERMINATION
14.1 Termination by You
You may terminate your account at any time by deleting your account through the Application settings. If you have an active paid subscription, termination terms (including any applicable refunds) will be governed by your Service Terms.
14.2 Termination by OZPATH PTY LTD
OZPATH PTY LTD may suspend or terminate your account immediately, without prior notice, if:
- (a) You breach any provision of these Terms or applicable Service Terms
- (b) You engage in fraudulent, illegal, or unauthorised activity
- (c) OZPATH PTY LTD is required to do so by law or court order
- (d) Your conduct damages OZPATH PTY LTD's reputation or violates the rights of others
- (e) Providing services to you is no longer commercially viable or feasible
14.3 Effect of Termination
Upon termination:
- (a) Your right to access and use OzPath will cease immediately
- (b) You will no longer have access to your account, data, or chat history
- (c) Any outstanding payment obligations remain due
- (d) OZPATH PTY LTD may delete your data in accordance with our Privacy Policy and data retention obligations
- (e) Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will continue to apply.
15. COMPETITOR USE PROHIBITION
If you are in the business of providing similar services to OzPath for commercial gain (whether to business or individual users), you are considered a competitor and are prohibited from using or accessing the Application or any of its content.
If you breach this provision, OZPATH PTY LTD will hold you fully responsible for any losses sustained and accountable for any profits derived from such breach.
16. DISPUTE RESOLUTION
16.1 Compulsory Process
Before commencing any legal proceedings (except where urgent interlocutory relief is required), the parties must follow this dispute resolution process.
16.2 Notice of Dispute
A party claiming a dispute must provide written notice to the other party detailing:
- (a) The nature of the dispute
- (b) The desired outcome
- (c) The action required to settle the dispute
16.3 Negotiation and Mediation
Upon receipt of a dispute notice:
The parties must endeavor in good faith to resolve the dispute within 28 days through negotiation or other mutually agreed means.
If the dispute is not resolved within 28 days, the parties must either:
- (a) Agree on a mediator; or
- (b) Request appointment of a mediator by the Australian Mediation Association
16.4 Mediation Terms
- (a) Both parties are equally liable for the mediator's fees and reasonable expenses
- (b) Each party bears its own costs associated with the mediation
- (c) Mediation will be held in Sydney, Australia
- (d) All communications during mediation are confidential and treated as "without prejudice"
16.5 Termination of Mediation
If the dispute remains unresolved 2 months after the start of mediation, either party may request the mediator to terminate the mediation process.
17. GOVERNING LAW AND JURISDICTION
- (a) These Terms are governed by the laws of New South Wales, Australia.
- (b) Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
- (c) This choice of law and jurisdiction is made without reference to conflict of law principles.
18. GENERAL PROVISIONS
18.1 Changes to Terms of Service
Please be aware that we may change these Terms of Service in the future. We may modify these Terms at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website, within the Application, or via notice to your registered email address.
Material changes that significantly affect your rights or obligations will be communicated to you via email or in-app notification at least 14 days before taking effect. Your continued use of OzPath after such modifications constitutes your acceptance of the updated Terms.
If you do not agree to any modifications, you must immediately cease using the Application and may cancel your subscription in accordance with Section 12. Please check back from time to time to review these Terms of Service.
The "Last Updated" date at the end of these Terms indicates when the most recent changes were made.
18.2 Entire Agreement
These Terms, together with any applicable Service Terms, Privacy Policy, and other policies referenced herein, constitute the entire agreement between you and OZPATH PTY LTD regarding your use of OzPath.
18.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
18.4 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. OZPATH PTY LTD's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
18.5 Assignment
You may not assign or transfer these Terms or any rights granted hereunder without OZPATH PTY LTD's prior written consent. OZPATH PTY LTD may freely assign these Terms without restriction.
18.6 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and OZPATH PTY LTD.

19. ACKNOWLEDGMENT
By creating an account or using OzPath, you acknowledge that:
- (a) You have read and understood these Terms in full.
- (b) You agree to be bound by these Terms.
- (c) OzPath is a technology, information, planning, and case-management platform. It is not a migration agent or law firm and does not provide migration advice or legal advice.
- (d) Ruby AI provides general information only and is not migration advice, legal advice, or professional advice of any kind.
- (e) Neither Free access nor an OzPath Pro subscription includes Agent Chat, case management, or direct access to a registered migration agent.
- (f) Access to a registered migration agent begins through a paid video consultation booked through OzPath, or through a referral code issued directly by a registered migration agent.
- (g) Case management tools are available only to users with an active agent matter, including referral-code users and users who decide to proceed with an agent following a consultation.
- (h) Registered migration agents accessible through OzPath are independent professionals solely responsible for their own advice, professional services, service agreements, and migration work. OZPATH PTY LTD is not responsible for their advice, conduct, or the outcomes of any services delivered through the platform.
- (i) Any service quote accepted or service agreement signed through the platform forms a binding agreement solely between you and the agent. OZPATH PTY LTD is not a party to that agreement.
- (j) Translation services, video consultations, agent services, quotes, invoices, and OzPath Pro subscriptions may involve separate charges and may be subject to separate agreements.
- (k) You understand that subscription purchases are non-refundable, subject to your rights under the Australian Consumer Law.
- (l) EOI Dashboard data is historical and does not guarantee future invitation outcomes.
- (m) You are solely responsible for your immigration decisions and outcomes.
- (n) You must verify all information with official Department of Home Affairs sources before making visa application decisions.
- (o) You must provide accurate information and have lawful authority to upload or share any documents through the Application.
